General Terms and Conditions (AGB)

§ 1 Scope

These General Terms and Conditions (AGB) apply to all deliveries from Crocbrothers to consumers.
A consumer, as defined in § 13 BGB, is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.

§ 2 Contractual Partner

The purchase contract is concluded with Crocbrothers.

§ 3 Conclusion of Contract

  1. The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.

  2. By clicking the button [Buy/Order with obligation to pay], you submit a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

§ 4 Right of Withdrawal

  1. If you are a consumer under § 1, you are entitled to a right of withdrawal in accordance with legal provisions.

  2. If you exercise your right of withdrawal as a consumer under § 4 (1), you must bear the regular costs of returning the goods.

  3. Otherwise, the provisions outlined in the withdrawal policy below apply.

§ 5 Withdrawal Policy and Sample Withdrawal Form

(1) Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without providing any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us (Crocbrothers, ADDRESS, PHONE NUMBER, EMAIL ADDRESS) by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, which is not mandatory.

You may also electronically complete and submit the sample withdrawal form or another clear statement on our website (insert internet address). If you use this option, we will promptly send you confirmation (e.g., via email) of receipt of such withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the withdrawal right before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery costs (except for additional costs resulting from your selection of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we receive your withdrawal notice.

For this refund, we will use the same payment method that you used for the original transaction, unless explicitly agreed otherwise; in no case will you be charged any fees for this refund. We may withhold the reimbursement until we have received the returned goods or you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us (or, where applicable, the person authorized by us to receive the goods) without undue delay and at the latest within fourteen days from the day you notify us of your withdrawal. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You will bear the direct cost of returning the goods.

You are only responsible for any diminished value of the goods if it results from handling them in a manner not necessary to establish the nature, characteristics, and functionality of the goods.

§ 6 Prices and Shipping Costs

  1. The prices listed on the product pages include statutory VAT and other price components.

  2. In addition to the stated product prices, we charge a flat shipping fee of €4.95 per order for deliveries within Germany. Shipping costs are clearly communicated on the product pages, in the shopping cart, and on the order page.

§ 7 Delivery

  1. Delivery is only available within Germany via DHL.

  2. The delivery time is up to 3 days. Any deviations in delivery times will be stated on the respective product page.

§ 8 Payment

  1. Payment can be made by prepayment (bank transfer) or cash on delivery.

  2. If you choose prepayment, we will provide you with our bank details in the order confirmation, and the goods will be delivered upon receipt of payment.

§ 9 Retention of Ownership

The goods remain our property until full payment has been made.

§ 10 Warranty for Defects

DemoShop is liable for defects in goods in accordance with applicable legal regulations, particularly §§ 434 ff. BGB (German Civil Code).

§ 11 Dispute Resolution

The European Commission has created an online dispute resolution platform to facilitate out-of-court settlements for disputes arising from online purchase contracts. The platform is accessible at:
http://ec.europa.eu/consumers/odr.

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
